Terms of Service
Last Updated: August 26, 2026
1. Acceptance of Terms
Welcome to the Gallerist Network (the "Platform"), a digital art gallery and curation ecosystem. By connecting your cryptographic wallet (e.g., MetaMask), accessing the Platform services, or interacting with our smart contracts, you agree to comply with and be bound by these Terms of Service. If you do not agree, please do not use the Platform.
2. Web3 & Blockchain Interactions
The Platform operates using the Polygon blockchain network. When purchasing physical artworks or digital tokens (NFTs), you execute peer-to-peer cryptographic transactions.
- Immutability: All transactions executed on the blockchain are final, permanent, and cannot be reversed or modified by the Platform.
- Gas Fees: You are solely responsible for paying network transaction fees ("gas") required to execute smart contract operations.
- Wallet Custody: You maintain sole responsibility for the security of your private keys and seed phrases. The Platform never requests or stores your private key.
3. Roles & Account Registration
The Platform provides specialized cabinets for three roles:
- Master Gallerists: Responsible for licensing curators, creating geographic gallery branches, and defining transaction split parameters.
- Curators: Authorized to represent artists, catalog physical paintings, upload media files, and negotiate terms with collectors.
- VIP Collectors: Invited to browse exclusive catalogs, download Certificates of Authenticity, and execute digital purchases.
4. Digital Agreements & Provenance
Curators and Artists utilize our digital agreement tools to establish fixed price lists. Once digitally signed, the agreement is locked and serving as the legal source of truth. The subsequent NFT certificates represent cryptographic proof of provenance, referencing metadata stored on decentralized IPFS storage.
5. Limitation of Liability
The Platform is provided "as is" and "as available" without warranty of any kind. We are not liable for losses resulting from smart contract bugs, third-party wallet failures, blockchain network congestion, or hardware malfunctions.
